Terms of service

This terms of service agreement (“ Agreement”) is entered into between the artist and the client for the commission of an artwork (“ Work”). By commissioning the artist, the Client agrees to the following terms:Engagement
1. Client provides clear and complete requirements upfront, including reference, materials, or assets before Work begins.
2. Client warrants that they have the authority to enter this agreement be the point of contact and is solely responsible for decisions and approval during the process
3. Artist reserves the right to refuse projects, or request, based on Contant subject, or other reasons
4. Artist defines scope of work, features price deliverables, and other details for the project in a proposal in a format, according to artist discretion, which may include private message through Kofi, DeviantArt, Google documents, email, or other social media outlets (pending on clients preference) the details set forth by the artist, shall be agreed upon by the Client before Work begins.Content restrictions
1. Artist will not create content that is explicit offensive or inappropriate.
2. Specific restrictions include but are not limited to. Robots, explicit adult content (NSFW), fetish, excess of muscles, copy styles.Timeline and process
1. work completion requires 2 weeks minimum and may take up to 6 months depending on each project
2. Timeline. Depends on commission type complexity, and work loud.
3. Artis provides progress updates and seeks client feedback voluntarily
4. Final deliverables are provided by the artist using the chosen social media platform or similar file transfer tools
5. If there are any delays and adjustments to timeline, artist will inform the client
6. Clients must first agree to delays and amendments to timeline exceeding three months to stander communication channels
7. Delays in clients responses may affect completion times there for when an update has been sent and client does not respond within 14 days. (unless client has notified artist beforehand) Artist may continue with no revisions. (there will be no refunds in this event. Artis may attempt to contact client a second time within the 14 days.Revisions
1. 3 minor revisions, allowed per item, shown to the Client during this process.
2. Additional charges for excess revisions may be required
3. Revisions may affect progress and timelineCommunication
1. Ongoing communication and discussion will occur throughout the order, including work in progress idea, generation, and calibration, situational, updates, and more.Rights and usage
Artist right
1. The artist retains copyright ownership, redistribution and intellectual property rights, which includes but is not limited to display, advertising, printing. The work and work progress on websites, social media portfolios, public broadcast channels (I.e. Twitter.) and more.
Clients rights
1. Clients receive exclusive, usage rights to the work for personal use
2. Personal use means display on social media accounts for promotional purposes, with no direct monetization, such as profile, pictures, banners, and post: print and framing in personal spaces display.
3. Client must not claim work as their own, and must credit artist using their social tag/user name/link at the instance of display of the work or permanently on their website, social media profiles, broadcast channels and so on
4. Client must not edit or modify Work, in anyway without prior permission from Artist.Commercial, right
1. Commercial usage rates are not included, unless specified in the commission type or listing on the artist website.
2. Commercial right means usage of Work on streams videos, and other content or any monetized instances, or selling work to another party as a part of any product or on another platform
3. In the case of design work for the definition of the clients brand identity, such as character, design, logo design and more intellectual property rights of the designs are exclusively granted to the client for use production and modification purposes commercial on personal
4. Usage of work for AI (artificial intelligence) tools, platforms, or programs: ML (machine learning) tools, platforms, or programs: AI or ML training: NFT: Blockchain: or other for profit platforms/purposes is strictly prohibited
5. Additional charges will be required for commercial use, if not included typically 50% - 2x original costPayment and fees
1. Client pays upfront and in full for projects $100 or less
2. Work costing over $100 client must pay 50% or more upfront. The remainder is due at first completion preview of Work when no revisions are needed.
3.Invoices, proposal or payment link will be sent to Client. When Artist is ready to begin work client must not send money before artist requests payment.
4. Invoices must be paid within 72 hours, or the project may be cancelled
5. Prices are in USD and paid via PayPal, DeviantArt points, Kofi or other methods as provided by artist.
6. Prices may vary or change pending on complexity requirements, and or additional request
7. Once Work has begun or payment have been made the client acknowledges Work and deliverables are digital, and these are no physically shipped goods to receive
8. Client warrants they will not issue chargebacksRefunds
1. Full refund is available before the sketch process begins
2. Partial refund in the event artist is unable to complete work client will be informed in such cases and refunds may vary pending on what stage work is inWaitlist/ Ping List
Client may request to be placed on a waiting list/ Ping List if artists workload is full, this list is free for anyone to join however clients may be removed at any time for any reason. When the artist is finally available, client will be contacting.
1. Client is subject to price change, unless otherwise stated by Artist.
2. Client will have 48 hours to respond to Artist when their turn arises if there is no response Client will miss there turn and will be removed from the list.
